This Coffee Product Disclaimer (hereinafter the “Disclaimer”) is issued by Blue Collar Brand LLC, a Texas Limited Liability Company duly organized under the laws of the State of Texas, with its principal place of business located at [Client to provide address], and having designated websites at www.bluecollar-brand.com and www.bluecollarcoffee.online, and an official business email address michael@bluecollarbrands.org (hereinafter the “Company”).

This Disclaimer governs the purchase, possession, distribution, and consumption of all coffee products and liquid coffee beverages offered under the Company’s registered and trademarked brand (collectively, the “Products”), including without limitation, hot or cold brewed coffee, bottled coffee, canned coffee drinks, coffee concentrates, or any related consumables now or hereafter developed, whether sold via the Company’s website, authorized distributors, commercial vendors, or promotional campaigns.

1. DISCLAIMER OF LIABILITY

To the fullest extent permitted by law, the Company expressly disclaims any and all liability for personal injuries, allergic reactions, illnesses, health-related complications, or death arising out of or resulting from the handling, preparation, consumption, resale, storage, or use of the Company’s coffee products, whether such use is proper or improper, foreseeable or unforeseeable.

The Company further disclaims liability for any incidental or consequential damages resulting from:

• Caffeine sensitivity or overdose;
• Undisclosed medical conditions aggravated by caffeine or other ingredients;
• Use of the Products by minors, pregnant or nursing individuals, or persons with known contraindications to caffeine or stimulants;
• Consumption of expired, improperly stored, tampered, or adulterated Products beyond the Company’s chain of custody.

All Products are provided “AS IS” and “AS AVAILABLE”, with no express or implied warranties, including but not limited to:

• Any implied warranties of merchantability;
• Fitness for a particular purpose;
• Accuracy of labeling or nutritional content;
• Non-infringement of third-party rights.

The Customer acknowledges that the Products are not certified as medicinal, therapeutic, or diagnostic substances, and no representations have been made by the Company regarding health benefits or outcomes.

2. ASSUMPTION OF RISK

By purchasing, possessing, preparing, distributing, or consuming the Products, the Customer (defined to include any purchaser, end-user, recipient, or consumer of the Products) voluntarily assumes all risks, both known and unknown, associated with the use or ingestion of coffee and related beverages, including but not limited to:

• Elevated blood pressure, heart palpitations, insomnia, nervousness, anxiety, or cardiac distress;
• Severe allergic reactions, including anaphylaxis;
• Gastrointestinal discomfort, dehydration, or caffeine toxicity;
• Complications arising in chemically sensitive workplaces (e.g., oil fields, offshore rigs, or chemical refineries where heightened safety measures are in effect).

The Customer acknowledges that coffee and caffeine-based beverages may contain allergens, naturally occurring oils, acids, and other compounds that may be contraindicated for certain individuals or work environments.

3. NO MEDICAL OR SAFETY GUARANTEES

The Company does not represent, warrant, or imply that its Products are safe for all consumers. The Company does not offer medical advice and shall not be liable for any medical outcomes arising from the consumption of its Products.

The Products are not regulated by the U.S. Food and Drug Administration (FDA) as drugs or medical treatments and are not intended to diagnose, treat, cure, or prevent any disease or condition.

It is the sole responsibility of the Customer to:

• Review the ingredients, nutritional content, and warnings provided;
• Consult with a licensed physician or qualified health professional prior to consumption;
• Refrain from consumption if they suffer from any known allergies, sensitivities, or medical conditions exacerbated by caffeine or related compounds.

4. INDEMNIFICATION AND HOLD HARMLESS

The Customer agrees to indemnify, defend, and hold harmless Blue Collar Brand LLC, its officers, members, employees, agents, affiliates, successors, and assigns (collectively, the “Indemnified Parties”) from and against any and all claims, demands, actions, losses, damages, liabilities, costs, or expenses (including attorneys’ fees and court costs) arising from or in connection with:

• The Customer’s use, misuse, resale, or distribution of the Products;
• Any third-party claims arising from personal injury, death, or illness allegedly caused by the Products;
• The Customer’s failure to disclose health risks or dietary restrictions to end-users;
• Violation of local, state, federal, or international regulations regarding food safety, storage, and labeling.

5. LIMITATION OF LIABILITY

In no event shall the Company be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from or related to the Products, including but not limited to:

• Loss of life, bodily injury, or pain and suffering;
• Reputational harm, emotional distress, or business interruption;
• Loss of earnings or profits;
• Product recall, disposal, or destruction costs.

If any liability is found to exist, the Customer agrees that the maximum extent of the Company’s liability shall be limited to the actual purchase price of the specific Product at issue, excluding taxes, shipping, and handling.

6. INTERNATIONAL SALES AND REGULATORY COMPLIANCE

Customers located outside the United States accept sole responsibility for ensuring that:

• The importation, sale, and consumption of coffee Products is lawful in their jurisdiction;
• All customs, tariffs, and import duties are satisfied;
• The Products comply with any applicable labeling, health, or registration requirements.

The Company disclaims any liability for regulatory or customs-related seizures, penalties, or denials in foreign jurisdictions.

7. GOVERNING LAW AND DISPUTE RESOLUTION

This Disclaimer shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes, controversies, or claims arising out of or in connection with this Disclaimer shall be subject to exclusive resolution as follows:

• Venue: Harris County, Texas.
• Forum: Binding arbitration conducted under the Commercial Rules of the American Arbitration Association (AAA).
• Waiver of Class Actions: The Customer agrees not to initiate or participate in any class, collective, or representative proceeding.
• Time Limit: All claims must be brought within one (1) year of the alleged incident or they shall be permanently barred.

8. ACKNOWLEDGMENT

By purchasing, using, or consuming any coffee or liquid coffee Product manufactured, sold, or distributed by Blue Collar Brand LLC, the Customer hereby affirms that they:

• Have read and fully understood this Disclaimer;
• Accept full legal responsibility for the use or consumption of the Products;
• Knowingly and voluntarily waive any and all claims, legal actions, and rights to recovery against Blue Collar Brand LLC or its affiliates;
• Agree that this Disclaimer constitutes a legally binding agreement between the parties.
